These Terms of Service govern the contractual relationship between PixelLearn ("PixelLearn") and any individual or legal entity (the "Customer") wishing to access the services of the PixelLearn online course platform.
They apply both to professional customers (B2B) and to independent course creators and individual learners subscribing directly on the platform as consumers (B2C). Consumer-protective clauses (right of withdrawal, mediation) apply whenever the Customer acts outside any professional activity.
PixelLearn is a SaaS (Software as a Service) platform accessible via a web browser, requiring no installation, allowing users to create, distribute, and track online courses. It notably includes:
Pricing plans are available at pixellearn.fr/en/tarifs, which the Customer is deemed to have consulted before any subscription. Prices shown are for the "Creator" (independent course creator) plans and the "Pixel Create" add-on.
The service is accessible via an up-to-date modern web browser (Chrome, Firefox, Safari, Edge) and an internet connection. No third-party software is required. Customer data (course content, contacts, documents) is exportable at any time from their account, in standard formats (CSV, PDF).
Content in SCORM 1.2 and SCORM 2004 format can be imported and is natively playable in the LMS. The service requires no particular technical interoperability beyond a standard browser.
Applicable prices are those displayed on the pixellearn.fr/en/tarifs page at the time of subscription, in euros. The subscription is monthly or annual depending on the Customer's choice, automatically renewed on the same terms unless cancelled. Payment is collected by Stripe at the start of each billing period.
PixelLearn reserves the right to change its prices for the future, with at least 30 days' notice sent by email; such a change does not affect the price already paid for the current period, and the Customer may cancel without penalty before the new price takes effect.
Some offers (notably Creator subscriptions) include a 14-day free trial, with no credit card required to start it. At the end of the trial period, access to the relevant features is suspended until a paid subscription is taken out; content already created is retained.
Under articles L.221-18 et seq. of the French Consumer Code, a Customer acting as a consumer (an individual, outside any professional activity) has a 14-day period from subscription to exercise their right of withdrawal, without having to justify their decision or bear any costs other than those provided for in article L.221-23 of the same code.
Exception applicable to digital content and fully performed services. Under article L.221-28 of the French Consumer Code, the right of withdrawal cannot be exercised for the supply of digital content not provided on a physical medium, the performance of which began after the Customer's prior express agreement and express waiver of their right of withdrawal, nor for a service fully performed before the end of the withdrawal period with the Customer's prior express agreement, who acknowledges losing their right of withdrawal once the contract has been fully performed.
In practice: upon any paid subscription or any immediate access to digital content (a course, a Pixel Create generation, etc.), the Customer gives their express agreement and explicitly acknowledges, before payment, that they lose their right of withdrawal as soon as the service begins to be performed or the digital content is made available.

The Customer owns the rights to educational content they generate or have generated via the Pixel Create studio from their own instructions (courses, quizzes, scenarios, materials), subject to any third-party rights that may exist in documents they have imported themselves. The Customer is free to use, modify, distribute, and commercialize such content without restriction or royalty owed to PixelLearn.
PixelLearn remains the sole owner of the technology, algorithms, system prompts, and any software element of the Pixel Create studio, independently of content produced by its users.
AI-generated content may occasionally contain inaccuracies; it is the Customer's responsibility to review and validate it before distributing it to their own learners, particularly in a regulated context.
PixelLearn reserves the right to suspend or terminate access in the event of a breach of these Terms of Service. The Customer may cancel their subscription at any time from their account settings; cancellation takes effect at the end of the current period, without refund for the period already begun, except where otherwise provided by law (withdrawal, Section 6).
PixelLearn undertakes to implement the means necessary to ensure the platform's availability (indicative target of 99.5% per month). In the event of prolonged unavailability attributable to PixelLearn, a proportional credit may be granted upon request. PixelLearn's liability is limited to the amounts paid by the Customer over the preceding 12 months, except in cases of gross or willful misconduct.
PixelLearn cannot be held liable for the non-performance or delayed performance of its obligations resulting from a case of force majeure within the meaning of article 1218 of the French Civil Code, notably a breakdown or prolonged unavailability of a third-party technical provider (hosting, payment) beyond PixelLearn's reasonable control.
Any complaint may be sent to contact@pixellearn.fr. PixelLearn undertakes to acknowledge receipt and provide an initial response within 5 business days.
PixelLearn may amend these Terms of Service at any time. The applicable Terms are those in force on the date of subscription or renewal. Any substantial amendment is notified to the Customer by email at least 30 days before it takes effect.
Should any clause of these Terms be declared void or unenforceable, the remaining clauses shall retain their full validity and scope.
These Terms of Service are governed by French law. In the event of a dispute, the parties will endeavor to find an amicable solution. Failing that, the courts of Paris shall have jurisdiction, subject to mandatory jurisdiction rules applicable to consumers.
